第一章 投诉工作机构

根据省商务厅《湖北省商务厅外商投资企业投诉办事指南》(以下简称《办事指南》)相关要求,十堰市商务局负责全市外商投资企业投诉工作,负责受理外商投资企业、外国投资者认为行政机关(包括法律、法规授权的具有管理公共事务职能的组织)及其工作人员的行政行为侵犯其合法权益,向十堰市商务局申请协调解决的行为;以及向十堰市商务局反映投资环境方面存在的问题,建议完善有关政策措施的行为。

具体处理投诉事项如下:

(一)投诉市级有关行政机关及工作人员的行政行为损害其合法权益的;

(二)反映投资环境方面存在问题,建议本市有关政府部门、各县(市、区)政府完善相关政策措施的;

(三)本市内影响重大,本市外商投诉工作机构认为可以由其处理的;

(四)上级有关政府部门交办、转办、督办的投诉事项;

各县(市、区)人民政府指定部门或机构负责投诉工作,各县(市、区)外商投诉工作机构在市外商投诉受理机构(市商务局)的指导下开展工作,负责受理本县(市、区)外商投资企业投诉事项和市外商投诉受理机构转交的投诉事项。

市商务局组织与外商投资有关的政策法规宣传,开展外商投资企业投诉工作培训,推广投诉事项处理经验,提出相关政策建议,督促地方做好外商投资企业投诉工作,积极预防投诉事项的发生。

外商投资企业、外国投资者可按照《办事指南》的相关规定,通过信函、传真和电子邮件进行投诉。

第二章受理条件与要求

一、有关定义

(一)投诉

一是外商投资企业、外国投资者认为行政机关(包括法律、法规授权的具有管理公共事务职能的组织)及其工作人员的行政行为侵犯其合法权益,向投诉工作机构申请协调解决的行为。

二是投诉人向投诉工作机构反映投资环境方面存在的问题,建议完善有关政策措施的行为。

中华人民共和国境内的外商投资企业、外国投资者。

(三)被投诉人

市政府有关部门及其工作人员;各县(市、区)人民政府及其工作人员;在全市范围内有重大影响,市商务局认为可以由本局处理的事项中所涉及的行政机关及其工作人员。

二、投诉材料要求

投诉人提出投诉事项,应当提交书面投诉材料。投诉材料可以现场提交,也可以通过信函、传真、电子邮件、在线申请等方式提交。投诉材料应包括:

(一)投诉人的姓名或者名称、通讯地址、邮编、有关联系人和联系方式,主体资格证明材料,提出投诉的日期;

(二)被投诉人的姓名或者名称、通讯地址、邮编、有关联系人和联系方式;

(三)明确的投诉事项和投诉请求(投诉申请建议以《外商投资企业投诉书模板》进行书写);

(四)有关事实、证据和理由,如有相关法律依据可以一并提供;

(五)是否存在《投诉办法》第十四条第(七)、(八)、(九)项所列情形的说明。

投诉人反映投资环境方面存在的问题,投诉材料应当包括前款第(一)项规定的信息、投资环境方面存在的相关问题以及具体政策措施建议。

投诉材料应当用中文书写。有关证据和材料原件以外文书写的,应当提交准确、完整的中文翻译件。

投诉人可以委托他人进行投诉。投诉人委托他人进行投诉的,除上述规定的材料以外,还应当提交投诉人的身份证明、出具的授权委托书和受委托人的身份证明。授权委托书应当载明委托事项、权限和期限。

三、不予受理情形

(一)投诉主体不属于外商投资企业、外国投资者的;

(二)申请协调解决与其他自然人、法人或者其他组织之间民商事纠纷,或者不属于《投诉办法》规定的外商投资企业投诉事项范围的;

(三)不属于市商务局的投诉事项处理范围的;

(四)经通知补正后,投诉材料仍不符合要求的;

(五)投诉人伪造、变造证据或者明显缺乏事实依据的;

(六)没有新的证据或者法律依据,向市商务局重复投诉的;

(七)同一投诉事项已经由上级投诉工作机构受理或者处理终结的;

(八)同一投诉事项已经由信访等部门受理或者处理终结的;

(九)同一投诉事项已经进入或者完成行政复议、行政诉讼等程序的。

四、受理时限

(一)投诉材料不齐全的,市商务局在收到投诉材料后7个工作日内一次性以《外商投资企业投诉材料补正通知书》的形式书面通知投诉人在15个工作日内予以补正;

(二)市商务局接到完整齐备的投诉材料,7个工作日内作出是否受理的决定,符合投诉受理条件的,予以受理并向投诉人发出《外商投资企业投诉案件受理通知书》;

(三)不符合投诉受理条件的,市商务局于7个工作日内向投诉人发出《外商投资企业投诉案件不予受理通知书》并说明不予受理的理由;

(四)不属于市商务局受理范围的事项,可以告知投诉人向有关投诉工作机构提出投诉。

第三章 处理方式与流程

一、处理要求

(一)工作要求

市商务局在受理投诉后,应当与投诉人和被投诉人进行充分沟通,了解情况,依法协调处理,推动投诉事项的妥善解决。

根据投诉事项具体情况,市商务局可以组织召开会议,邀请投诉人和被投诉人共同参加,陈述意见,探讨投诉事项的解决方案。省商务厅根据投诉处理工作需要,可以就专业问题听取有关专家意见。

(二)投诉人义务

市商务局进行投诉处理时,可以要求投诉人进一步说明情况、提供材料或者提供其他必要的协助,投诉人应当予以协助;可以向被投诉人了解情况,被投诉人应当予以配合。

二、处理方式

根据投诉事项情况,市商务局可以采取下列方式进行处理:

(一)推动投诉人和被投诉人达成谅解(包括达成和解协议);

(二)与被投诉人进行协调;

(三)提交完善相关政策措施的建议;

(四)其他适当的处理方式。

投诉人和被投诉人签署和解协议的,应当写明达成和解的事项和结果。依法订立的和解协议对投诉人和被投诉人具有约束力。被投诉人不履行生效和解协议的,依据《中华人民共和国外商投资法实施条例》第四十一条的规定处理。

三、处理期限

市商务局在受理投诉之日起60个工作日内办结受理的投诉事项。涉及部门多、情况复杂的投诉事项,可以适当延长处理期限。

四、终结事由

有下列情况之一的,投诉处理终结:

(一)投诉工作机构依据《投诉办法》第十八条进行协调处理,投诉人同意终结的;

(二)投诉事项与事实不符的,或者投诉人拒绝提供材料导致无法查明有关事实的;

(三)投诉人的有关诉求没有法律依据的;

(四)投诉人书面撤回投诉的;

(五)投诉人不再符合投诉主体资格的;

(六)经投诉工作机构联系,投诉人连续30日无正当理由不参加投诉处理工作的;

(七)投诉处理期间,出现《投诉办法》第十四条第(七)、(八)、(九)项所列情形的,视同投诉人书面撤回投诉。

投诉处理终结后,市商务局应当在3个工作日内将投诉处理结果书面通知投诉人。

五、结案登记

投诉案件办结,应对协调处理的案件进行结案登记、归档,案件材料、相关工作日志和处理结果要详实完备。

被投诉人:单位名称及工作人员姓名、通讯地址、邮编、有关联系人和联系方式。

一、投诉事项及明确诉求(明确概括、合法合理);

二、有关事实、证据和理由,如有相关法律依据可以一并提供;

Chapter I complaint work organization

According to the relevant requirements of the Provincial Department of Commerce of Hubei Department of Commerce Handling Guidelines for Complaints of foreign-invested enterprises (hereinafter referred to as the Handling guidelines), Shiyan Bureau of Commerce is responsible for the complaints of foreign-invested enterprises in the city, and is responsible for accepting the complaints of foreign-invested enterprises and foreign investors considered by the administrative organs (including laws) The organization with the function of managing public affairs authorized by regulations) and its staff members' administrative acts violate their legitimate rights and interests and apply to Shiyan Bureau of Commerce for a coordinated solution; As well as to the Shiyan City Bureau of Commerce to reflect the problems existing in the investment environment, suggestions to improve the behavior of relevant policies and measures.

Specific complaint handling matters are as follows:

(1) Complaining about the administrative acts of the relevant administrative organs and staff at the municipal level that damage their legitimate rights and interests;

(2) Reflecting the problems in the investment environment and suggesting the relevant government departments of the city and the county (city, district) governments to improve relevant policies and measures;

(4) Complaints assigned, transferred and supervised by relevant government departments at higher levels;

The departments or institutions designated by the people's governments of all counties (cities, districts) are responsible for the complaint work. The foreign complaint work institutions of all counties (cities, districts) carry out their work under the guidance of the Municipal Foreign complaint acceptance institutions (Municipal Bureau of Commerce), and are responsible for accepting the complaints of foreign-invested enterprises of their counties (cities, districts) and the complaints transferred by the Municipal Foreign complaint acceptance institutions.

The Municipal Bureau of commerce organizes the publicity of policies and regulations related to foreign investment, carries out training on complaint work of foreign-invested enterprises, promotes the experience in handling complaints, puts forward relevant policy suggestions, urges the local authorities to do a good job in complaint work of foreign-invested enterprises, and actively prevents the occurrence of complaints.

Foreign investment companies and foreign investors can complain through letters, faxes and emails in accordance with the relevant provisions of the Guide of the Inffectiveness.

Chapter II Conditions and Requirements

1. Relevant definitions

(1) Complaint

First, foreign-invested enterprises and foreign investors believe that the administrative acts of administrative organs (including organizations authorized by laws and regulations to manage public affairs) and their staff infringe upon their legitimate rights and interests, and apply to the complaint work agency for coordination and settlement.

Second, the complainant reflects the problems in the investment environment to the complaint work agency, and suggests to improve the behavior of relevant policies and measures.

(2) Complainants

Enterprises with foreign investment and foreign investors within the territory of the people's Republic of China.

(3)Respondent

The relevant departments of the municipal government and their staff; The people's governments of all counties (cities and districts) and their staff; The administrative organs and their personnel involved in the matters that the municipal Bureau of Commerce considers to be of great influence in the whole city.

2.Complaint material requirements

When lodging a complaint, the complainant shall submit written complaint materials. Complaint materials can be submitted on site, by letter, fax, email, online application, etc. The complaint material should include:

(1)The name, mailing address, postal code, relevant contacts and contact information of the complainant, materials certifying the subject's qualifications, and the date of filing the complaint;

(2)The name, mailing address, postal code, relevant contacts and contact information of the person against whom the complaint is filed;

(3)Clear complaint matters and complaint requests (the complaint application is suggested to be written in the template of Complaint Letter for Foreign-invested Enterprises);

(4)Relevant facts, evidence and reasons, if any, can be provided together with relevant legal basis;

(5)Whether there is a description of the circumstances listed in Item (7), (8) and (9) of Article 14 of the Measures for Complaints.

When the complainant reports the existing problems in the investment environment, the complaint materials shall include the information stipulated in Item (1) of the preceding paragraph, the relevant problems in the investment environment, and specific policy and measure suggestions.

The complaint materials shall be written in Chinese. If the original relevant evidence and materials are written in a foreign language, an accurate and complete Chinese translation shall be submitted.

A complainant may entrust another person to make a complaint. Where a complainant entrusts another person to make a complaint, it shall, in addition to the above-mentioned materials, submit the identity certificate of the complainant, the power of attorney issued by the complainant and the identity certificate of the trustor. A power of attorney shall specify the items entrusted, the authority and the time limit.

3.The situation of not accepting

(1) The subject of the complaint does not belong to foreign-invested enterprises or foreign investors;

(2) Apply for the settlement of civil and commercial disputes with other natural persons, legal persons or other organizations, or do not fall within the scope of complaints of foreign-invested enterprises as stipulated in the Complaint Measures;

(3) Those that do not fall within the scope of complaint handling by the McOmmerce Bureau;

(4)The complaint materials still do not meet the requirements after being notified to make corrections;

(5)The complainant forges or alters evidence or obviously lacks factual basis;

(6) making repeated complaints to the MBC without new evidence or legal basis;

(7)The same complaint has been accepted or finished by the complaint working body at a higher level;

(8)The same complaint has been accepted or finished by the complaint reporting or other departments;

(9)The same complaint has entered into or completed the procedures of administrative reconsideration, administrative litigation, etc.

4.Time limit for acceptance

(1)If the complaint materials are not complete, the Municipal Bureau of Commerce shall, within 7 working days after receiving the complaint materials, notify the complainant in writing in the form of "Notice of Correction of Complaint Materials of Foreign-Invested Enterprises" to make corrections within 15 working days;

(2) Upon receiving the complete and complete complaint materials, the Municipal Bureau of Commerce shall decide whether to accept the complaint or not within 7 working days. If the conditions for accepting the complaint are met, it shall accept the complaint and issue the Notice of Accepting the Complaint Case of Foreign-Invested Enterprises to the complainant;

(3) If the applicant does not meet the conditions for complaint acceptance, the Municipal Bureau of Commerce shall, within 7 working days, issue the Notice of Rejection of Complaint Cases of Foreign-Invested Enterprises to the complainant and explain the reasons for rejection;

(4) If the matter does not fall within the scope of acceptance by the MSCB, it may inform the complainant to lodge a complaint with the relevant complaint working organization.

Chapter III processing methods and procedures

1.Processing requirements

(1)Job requirements

After accepting a complaint, the Municipal Bureau of Commerce shall fully communicate with the complainant and the respondent, understand the situation, coordinate and handle the matter according to law, and promote the proper settlement of the complaint.

According to the specific situation of the complaint matter, the municipal Bureau of Commerce may organize a meeting to invite the complainant and the respondent to participate in the meeting, state their opinions and discuss the solution of the complaint matter. The provincial Department of Commerce may, according to the needs of complaint handling, listen to the opinions of relevant experts on professional issues.

(2)Obligations of the complainant

In handling a complaint, the Municipal Bureau of Commerce may request the complainant to further explain the situation, provide materials or provide other necessary assistance, and the complainant shall provide assistance; They may seek information from the respondent, and the respondent shall cooperate.

2.The way of handling

According to the situation of the complaint, the municipal Bureau of Commerce may take the following ways to deal with it:

(1) To facilitate the complainant and the respondent to reach an understanding (including a settlement agreement);

(2)To coordinate with the respondent;

(3)To submit suggestions on improving relevant policies and measures;

(4)Other appropriate means of disposal.

When the complainant and the respondent sign a settlement agreement, the matters and results of the settlement shall be clearly stated. A settlement agreement concluded in accordance with the law shall be binding on the complainant and the respondent. If the respondent fails to perform the effective settlement agreement, it shall be dealt with in accordance with Article 41 of the Regulations for the Implementation of the Foreign Investment Law of the People's Republic of China.

3.Time limit for processing

The Municipal Bureau of Commerce shall settle the complaint within 60 working days from the date of accepting the complaint. If the complaint involves many departments and the situation is complex, the processing time may be extended appropriately.

4.Cause of termination

The complaint handling shall be terminated under any of the following circumstances:

(1)The complaint handling agency conducts coordinated handling according to Article 18 of the Measures for Complaints, and the complainant agrees to terminate;

(2)The matter of the complaint is not consistent with the facts, or the complainant refuses to provide materials, so that the relevant facts cannot be ascertained;

(3)The relevant appeal of the complainant has no legal basis;

(4)The complainant withdraws the complaint in writing;

(5)The complainant no longer meets the qualifications of the complaint subject;

(6)The complainant fails to participate in the complaint handling work for 30 consecutive days without justifiable reasons after being contacted by the complaint handling agency;

(7) During the period of complaint handling, if any of the circumstances listed in Item (7), (8) and (9) of article 14 of the measures for complaints occurs, the complainant shall be deemed to have withdrawn the complaint in writing.

After the end of complaint handling, the MBC shall notify the complainant of the result of complaint handling in writing within 3 working days.

5.Closing registration

When handling complaint cases, the case shall be registered and filed, and the case materials, related work logs and processing results shall be detailed and complete.

Complaint from foreign-invested enterprises

Complainant: the information of the company or itself (including the name, nationality, unit, mailing address, postal code, relevant contact person and the landline or mobile phone in mainland China that can be contacted, etc.; If there is a client, the client must present the power of attorney, the identity of the client and contact information).

Respondent: Name of the unit and the name of the staff, mailing address, postal code, relevant contacts and contact information.

1.Complaint matters and clear appeals (clear generalization, legal and reasonable);

2.Relevant facts, evidence and reasons, if relevant legal basis is available, may be provided together;

Relevante Abteilungen der Kommunalverwaltung und deren Mitarbeiter; Bezirksregierung (Stadt, Bezirk) und ihre Mitarbeiter; Die Verwaltungsorgane und ihre Mitarbeiter, die mit den Angelegenheiten befasst sind, die nach Ansicht des Kommunalen Handelsbüros von diesem Büro bearbeitet werden können.

2.Beanstandung materielle Anforderungen

Die Beschwerdeführer müssen schriftliche Beschwerdeunterlagen einreichen, wenn sie Beschwerden einreichen. Beschwerdeunterlagen können vor Ort oder per Brief, Fax, E-Mail, Online-Bewerbung usw. eingereicht werden. Zu den Beschwerdematerialien gehören:

(1)Der Name oder Name der Beschwerde, die Adresse, die Mailingadresse, die Postleitzahl, die entsprechenden Kontaktinformationen, das Thema Qualifikationszertifikat und das Datum der Beschwerde;

(2)Die Namen oder Namen des Befragten, Name, Mailingadresse, Postleitzahl, zugehörige Kontaktinformationen;

(3)Klare Beschwerdeangelegenheiten und Beschwerdeanträge (die Vorschläge für den Antrag auf Beschwerde werden in Form eines Beschwerdeschreibens von ausländischen investierten Unternehmen verfasst);

(4)Relevante Tatsachen, Beweise und Gründe, wenn es eine relevante rechtliche Grundlage gibt, kann sie zusammen zur Verfügung gestellt werden;

(5)Eine Beschreibung, ob es Situationen gibt, die in Artikel 14 der Beschwerdemaßnahmen unter den Buchstaben 7), 8 und 9 aufgeführt sind.

Der Beschwerdeführer spiegelt die Probleme wider, die im Investitionsumfeld vorliegen. Die Beschwerdematerialien sollten die Informationen in den in den vorangegangenen Absatz (1) angegebenen Informationen und die relevanten Probleme im Investitionsumfeld sowie den Vorschlag für spezifische Richtlinien und Maßnahmen enthalten.

Beschwerdematerialien sollten auf Chinesisch geschrieben werden. Wenn die relevanten Beweise und die Originalmaterialien von ausländischer Literatur verfasst werden, werden genaue und vollständige chinesische Übersetzungen eingereicht.

Der Beschwerdeführer kann andere mit der Einreichung einer Beschwerde beauftragen. Beauftragt der Beschwerdeführer eine andere Person mit der Beschwerde, so legt er neben den oben genannten Unterlagen auch den Identitätsnachweis des Beschwerdeführers, die erteilte Vollmacht und den Identitätsnachweis der beauftragten Person vor. In der Vollmacht sind die anvertrauten Gegenstände, Befugnisse und Fristen anzugeben.

3.Keine Akzeptanzsituation

(1) Der Hauptteil der Beschwerde ist kein ausländisches Unternehmen und ausländische Investoren.

(2) Antrag auf Koordinierung und Lösung von Streitigkeiten zwischen Menschen und Geschäftsstreitigkeiten mit anderen natürlichen Personen, Rechtspersonen oder anderen Organisationen oder dem Umfang von Beschwerden für ausländische investierte Unternehmen, die in den "Beschwerdemaßnahmen" festgelegt sind;

(3)Nicht in den Anwendungsbereich der Bearbeitung von Beschwerden durch das städtische Handelsamt fallen;

(4)Die Reklamationsunterlagen entsprechen nach der Mitteilung über Korrekturen immer noch nicht den Anforderungen;

(5)Der Beschwerdeführer fälscht oder ändert Beweise oder es fehlt offensichtlich an sachlicher Grundlage;

(6) wiederholte Beschwerden an das städtische Handelsamt ohne neue Beweise oder Rechtsgrundlage;

(7)Dieselbe Beschwerde wurde von der übergeordneten Beschwerdearbeitsorganisation angenommen oder bearbeitet;

(8)Dieselbe Beschwerde wurde von Dienststellen wie Briefen und Besuchen angenommen oder bearbeitet;

(9)Die gleiche Beschwerde hat administrative Überprüfung, Verwaltungsverfahren und andere Verfahren eingeleitet oder abgeschlossen.

4.Annahmefrist

(1)Wenn die Beschwerdematerialien unvollständig sind, benachrichtigt das kommunale Handelsbüro den Beschwerdeführer schriftlich in Form der "Bekanntmachung der Korrektur von Beschwerdematerialien für ausländische Investitionsunternehmen Beschwerdematerialien" innerhalb von 7 Arbeitstagen nach Erhalt der Beschwerdematerialien.

(2) Das Kommunale Handelsamt entscheidet innerhalb von sieben Werktagen nach Erhalt der vollständigen und vollständigen Beschwerdeunterlagen über die Annahme der Beschwerde. Sind die Bedingungen für die Annahme der Beschwerde erfüllt, nimmt es die Beschwerde an und gibt dem Beschwerdeführer die Mitteilung über die Annahme von Beschwerdefällen ausländischer Unternehmen aus;

(3) Sind die Voraussetzungen für die Annahme einer Beschwerde nicht erfüllt, so stellt das Kommunale Handelsamt dem Beschwerdeführer innerhalb von sieben Arbeitstagen eine Ablehnung von Beschwerdefällen ausländischer Unternehmen aus und erläutert die Gründe für die Ablehnung;

(4) Bei Angelegenheiten, die nicht in den Geltungsbereich der Annahme durch das städtische Handelsamt fallen, kann der Beschwerdeführer unterrichtet werden, eine Beschwerde bei der zuständigen Beschwerdeagentur einzureichen.

Kapitel III Handhabungsmethoden und -verfahren

1.Anforderungen an die Handhabung

(1)Arbeitsanforderungen

Nach Annahme der Beschwerde kommuniziert das Kommunale Handelsbüro vollständig mit dem Beschwerdeführer und dem Beschwerdegegner, versteht die Situation, koordiniert die Behandlung gemäß Gesetz und fördert die ordnungsgemäße Beilegung der Beschwerde.

Gemäß den spezifischen Bedingungen der Beschwerden kann das Kommunale Handelsbüro ein Treffen organisieren, um die Beschwerdeführer und die Beschwerdegegner zur Teilnahme einzuladen, ihre Meinung zu äußern und die Lösungen der Beschwerden zu diskutieren. Das Provinzielle Handelsministerium kann, je nach Bedarf, die Meinungen relevanter Experten zu beruflichen Fragen anhören.

(2)Pflichten der Beschwerdeführer

Wenn das kommunale Handelsbüro Beschwerden einleitet, kann es den Beschwerdeführer auffordern, die Situation weiter zu erklären, Materialien zu liefern oder andere notwendige Unterstützung zu leisten, und der Beschwerdeführer behilflich ist. Sie können die Situation vom Beschwerdegegner verstehen, und der Beschwerdegegner sollte kooperieren.

2.Behandlungsmethode

Nach der Situation der Beschwerde kann das kommunale Handelsbüro die folgenden Verarbeitungsmethoden einnehmen:

(1) Förderung des Verständnisses des Beschwerdeführers und des Beschwerdegegners (einschließlich des Erreichens einer Vergleichsvereinbarung);

(2)Abstimmung mit dem Beschwerdegegner;

(3)Vorschläge zur Verbesserung der einschlägigen Politiken und Maßnahmen unterbreiten;

(4) Andere geeignete Behandlungsmethoden.

Die Beschwerde und der Beschwerdegegner unterzeichneten eine Versöhnungsvereinbarung, die die Angelegenheiten und Ergebnisse der Versöhnung stimuliert.

Die gemäß dem Gesetz festgelegte Versöhnungsvereinbarung ist für die Beschwerde und den Beschwerdegegner verbindlich.

Der Befragte erfüllt nicht die Wirksamkeit des wirksamen Versöhnungsvertrags, der gemäß Artikel 41 der Umsetzungsbestimmungen der Volksrepublik China behandelt wird.

3.Der Verarbeitungszeitraum

Das Kommunale Handelsamt vervollständigt die angenommenen Beschwerden innerhalb von 60 Werktagen ab dem Tag der Annahme der Beschwerden. Bei Beschwerden mit vielen Abteilungen und komplizierten Situationen kann die Bearbeitungsfrist angemessen verlängert werden.

4.Kündigungsgrund

Unter folgenden Umständen wird die Reklamationsbearbeitung beendet:

(1)Die Beschwerdearbeitsorganisation koordiniert und bearbeitet gemäß Artikel 18 der Beschwerdemaßnahmen, und der Beschwerdeführer stimmt zu, die Beschwerde zu beenden;

(2)Die Beschwerde widerspricht den Tatsachen oder der Beschwerdeführer weigert sich, Unterlagen vorzulegen, was es unmöglich macht, die einschlägigen Tatsachen herauszufinden;

(3)Die Beschwerde hat keine Rechtsgrundlage;

(4)Der Beschwerdeführer zog die schriftliche Beschwerde zurück;

(5)Der Beschwerdeführer ist nicht mehr Gegenstand der Beschwerde;

(6)Der Beschwerdeführer nimmt an den Beschwerdebearbeitungsarbeiten für 30 aufeinanderfolgende Tage ohne begründete Gründe nicht teil, nachdem er von der Beschwerdebearbeitungsorganisation kontaktiert wurde;

(7) Im Falle einer der in Artikel 14 (7), (8) und (9) der Maßnahmen zur Behandlung von Beschwerden aufgeführten Situationen wird davon ausgegangen, dass der Beschwerdeführer die Beschwerde schriftlich zurückgezogen hat.

Nach Beendigung der Beschwerdebearbeitung teilt das Kommunale Handelsamt dem Beschwerdeführer das Ergebnis der Beschwerdebearbeitung innerhalb von drei Werktagen schriftlich mit.

5.Abschluss der Registrierung

Nach der Klärung der Beschwerdefälle werden die koordiniert behandelten Fälle registriert und eingereicht. Die Fallunterlagen, einschlägigen Arbeitsprotokolle und Bearbeitungsergebnisse sind detailliert und vollständig zu sein.


Beschwerdeschreiben ausländischer Unternehmen

Beschwerdeführer: die Informationen des Unternehmens oder selbst (einschließlich Name, Staatsangehörigkeit, Einheit, Postanschrift, Postleitzahl, relevante Kontaktperson und das Festnetz- oder Mobiltelefon, das auf dem chinesischen Festland der Beschwerdeführer und beauftragten Vertreter kontaktiert werden kann; wenn es eine beauftragte Person gibt, werden die Vollmacht, der Identitätsnachweis und die Kontaktdaten der beauftragten Person ausgestellt).

Beschwerdegegner: Name der Einheit und des Personals, Postanschrift, Postleitzahl, relevante Ansprechpartner und Kontaktdaten.

1.Beschwerden und klare Forderungen (klar und allgemein, legal und vernünftig);

2.Relevante Tatsachen, Beweise und Gründe, falls vorhanden, können zusammen mit der einschlägigen Rechtsgrundlage vorgelegt werden;

3.Der Beschwerdeführer verspricht, dass die Beschwerde nicht von der übergeordneten Beschwerdearbeitsorganisation angenommen oder behandelt wurde; Sie wurde von Dienststellen wie Briefen und Besuchen nicht angenommen oder bearbeitet; Nichteintritt oder Beendigung der Verfahren der administrativen Überprüfung und administrativen Rechtsstreitigkeiten.

Angelegenheiten, die Aufmerksamkeit erfordern:

1.Das Beschwerdematerial umfasst das bewährte Material für die Hauptqualifikation der Beschwerde.

2.Die Beschwerde muss in chinesischer Sprache verfasst oder ausgedruckt werden. Wenn das Original der relevanten Beweise und Materialien in einer Fremdsprache geschrieben ist, ist eine genaue und vollständige chinesische Übersetzung vorzulegen.
